RPS Canyon wont shift gears

Hello I have a pretty much new rps canyon 250cc with the shaft drive that is having a shifting issue. It is semi auto (no clutch but gears) and it will shift into 1st (down like a motorcycle) or 2nd (up one) but after that it wont shift at all. No grinding but you physically cant get the shifter to move. it is a foot shifter. I changed the oil and refilled with rotella 15-40w but no go. No metal shavings in the oil and it runs fine in first or second just wont shift out of those gears? where do I go from here????
